Dear Owners:
The Pine Meadow Ranch Home Owners Association (PMRHOA) is proposing the implementation of a new “Rule and Regulation” that deals specifically with both short-term and long-term rentals within the boundaries of the Association. The PMRHOA board has approved the new “Rule and Regulation” and we are now seeking input from owners.
You may review the proposed rule HERE.
From a historical standpoint, rentals, both short-term and long-term, have posed significant challenges due to their increasing numbers over the past decade. The HOA frequently receives numerous complaints regarding renters who disregard our established "Rules and Regulations" and rental property owners failing to take responsibility for their tenants.
A previous effort to disallow short-term rentals sparked controversy during attempts to modify our CC&Rs some years ago. However, it is important to note that state statute prevents the HOA from prohibiting owners from establishing rentals unless explicitly stated in our CC&Rs. Nevertheless, state statute also grants the HOA the authority to regulate rental operations within the community and mandate that owners ensure their tenants adhere to all the "Rules and Regulations" that owners themselves are obligated to follow.
We encourage all owners to become familiar with this proposed Rule and Regulation. We also ask for your input. We will review owner input before making a final decision on the implementation of this rule.
We will accept comment over the next 15+ days, beginning July 15, 2023 and until 5:00 PM, Sunday, July 30, 2023. Please watch your email for a rule change proposal. The email will contain a link to record your response and make comments.

May 19, 2023 - Small Pond Break sends Water, Rock, and Debris over Tollgate Canyon Road
Over the course of two days between May 14th and 15th, a small pond experienced two breaks in the same location, sending water, rock and debris cascading down Tollgate Canyon Road. Unfortunately, the water surge from the second day’s late afternoon break damaged the road, most noticeably along the east side from just below Crowley’s / Boyce’s corner to approximately ¼ mile below the Hillcrest / Oilwell intersection.
Some of the road did cave in and we've coned it off. At the rate water was flowing, the damage would have been extensive had it not been for one of our locals on the mountain, Rykstone Construction, and our Ranch Manager, Jody Robinson. Rykstone brought in their excavator to re-channel and divert the floodway that was undermining the road. They had to completely remove some plugged culverts on the east side that were channeling water on the surface and underneath the roadbed. One culvert had a giant boulder deep inside. Rykstone and Jody finished up around 11 pm on that second night. Tollgate Canyon was not closed and remains open.
We are currently asking crews with experience in road construction and repair to examine the road’s damage from top to bottom and provide estimates on the cost of repair.
In light of these events, the HOA Board has not lifted Winter Construction Rules and they remain in effect until June 1, 2023.

May 11, 2023 - Tollgate Canyon Road Reopens
Tollgate Canyon Road has reopened, today, through the help of Pine Meadow Mutual Water Company. We extend our gratitude to Brody, the water company's Manager and System Operator and Jody, HOA Ranch Manager, for their Cooperative effort in removing mudslide debris and dislodging a large boulder that was redirecting snowmelt and eroding a section of Tollgate Canyon Road. Please be aware that the area remains at risk for future mudslides and use extreme caution. Also, note, Winter Construction Rules remain in effect until June 1, 2023.

Although roads are beginning to dry out, many remain wet and saturated. Jody now plans to clear the mudslide area of Tollgate Canyon Road (TGC Rd) during the week of May 15th. This date could change. In addition, a small section of TGC Rd has now collapsed along the west side due to water erosion near the Rocky Point Preserve and will need to be repaired. A very large boulder sitting in the stream at this location has created the problem by constricting waterflow. We will need a large backhoe or excavator to remove it. In the meantime, sandbags and small boulders have been placed to lessen the erosion along the impacted section. Additionally, Forest Meadow Road is in poor shape, particularly above the Bullmoose / tricycle sign intersection.
With this in mind, the HOA Board voted over the weekend to extend Winter Construction Rules until June 1, 2023.
Additionally, we received another planning update regarding TGC Rd’s mudslide risk through conversations with AGEC, a soil analysis and engineering firm. Here is what we learned: 1) Arial maps show at least 12 historical mudslides along TGC Rd. 2) The HOA could spend a couple thousand dollars on a study from AGEC, but, the simple truth is that the steep slopes and narrow passageway of TGC Rd make it more susceptible to mudslide risks. 3) To properly engineer the road to eliminate mudslide risks to traffic would cost in excess of $10 million due to the length of the road. 4) The most viable and immediate option is to identify the source of streams higher up (along Oilwell and other areas) and divert the flow of water to the south through ditches, culverts, and large drain pipes. This, however, will also take time and planning. 5) Given the remaining risk of mudslides along TGC Rd that may persist over the long-term, signs should be posted at the entrances to TGC Rd stating, "Entering Mudslide Area, Proceed at Your Own Risk."
As a result, the HOA Board voted over the weekend to purchase two 18" x 24" reflective warning signs that will be placed at or near the Forest Meadow Road intersection with Tollgate Canyon Road and the intersection with Hillcrest.

Summit County continues to pursue outside funding opportunities that could improve the availability of Broadband / High-speed Internet for underserved communities within the County. The County has asked the HOA if it would notify the Tollgate Community of its efforts and an important survey that is underway. Owners who complete the survey will be contributing information that will make up the County’s "Community Broadband Plan.” One of the survey’s goals is to find out why there is a gap between what the local communications companies are offering and what residents have available to them. Tuesday, May 2, 2023 - Mudslide Update
- More Water on TGC Rd: Looking at Tollgate Canyon Road (TGC Rd) today, there were no new mudslides but it appears we had an uptick in the amount of water and mud flowing downstream. Unfortunately, one of our sandbag areas is now plugged with rocks and mud. Further down, sizable stones cover the road. The original mudslide area is also still full of mud.
- Where will we put it? All the debris will need to go somewhere. When it is safe, Jody plans to use HOA equipment, first, to push the debris to the side and stage it for late spring.
- "Tentative" reopening date is Mother's Day Weekend (May 12-14th): Water flow needs to subside across the original mudslide area and we are hoping the next 10-to-12 days will get us there, which, puts us at May 12-14th. If anything changes, we will let everyone know.
- At approximately 9:00 AM Wednesday morning, Oilwell will open to through traffic: We will finally have a more direct connection for anyone traveling north and south starting Mid-morning on Wednesday. Expect to see water running across and along portions of Oilwell. The most southern section will be dry. Now that all the snow has been removed from Oilwell, however, there is nothing along this ridge to hold back the melt-water flowing from this area of the mountain. This could explain why we may have had an uptick in water flow further down along TGC Rd.

Monday, May 1, 2023 - Mudslide Update
- Third Mudslide: We experienced a third mudslide overnight. It was smaller and about 1/2 to 3/4 of a mile up Tollgate Canyon Road (TGC Rd.) from the base of the mountain. Here is a Google link that shows all mudslide locations: HERE
- Why haven't we reopened the road? We believe the area is still unsafe. Evergreen Engineering who designed TGC Road has put us in touch with a soils engineering group. Our immediate option would be to locate the source of water and divert it safely somewhere else. Because of the saturated walls below the first two mudslides, if we don't divert water we would need to dig a very large ditch to absorb future slides if we want it to be safe. Alternatively, we will need to wait it out and let it dry.
- Oilwell to serve as an alternative route connecting TGC Rd with Forest Meadow Rd. in a few days: RS Recovery has been on Oilwell today opening it with a large V-Plow on the front of their grader. The snow was too heavy for their blower, and, the crew still has another 500 feet to go. Oilwell is also still very saturated along 1/3 to 1/2 of the route. It needs to dry out before traffic starts using it.
- No sandbag was injured: All of the work our community put into sandbags on Sunday is still intact and doing what it is supposed to!
- Not at all ideal: We understand how absolutely inconvenient this is for everyone. The Board is discussing whether or not to clear the mudslides from the road. But, before we do that, we also want to make sure that the area is safe. Yes, we have many on the mountain who have seen worse conditions and lived to tell stories about it. That's one of the many things that makes this such a unique community. Despite those strengths in many of you, we care enough to want to make sure we aren't putting you at risk. Sunday, April 30, 2023 - Part 2 - Mudslides
- We experienced two mudslides on Tollgate Canyon Rd. just after 6:00 pm - both in the same location - North of Rocky Point and below the driveway with a gate on the West side.
- A handful of residents were on scene to assess and to begin clearing the roadway when the same side of the mountain gave way with much more mud, water, and debris. No one was injured but everyone had to run to get out of the way.
- North Summit Fire District (NSFD) arrived from the south to investigate. It appears we have a second section of the mountain about 100 yards lower that they are worried about and believe it, too, could slide off at any moment. If anyone is thinking of sightseeing in the general area, please don't. We’ve sent out an alert for everyone to stay away. It is unsafe and the speed of a mudslide is difficult to imagine.
- The primary route in and out of Tollgate is now along Arapaho and Forest Meadow Road. We will begin clearing the remaining snow along Oilwell at Forest Meadow to Tollgate Canyon Rd tomorrow morning (Monday). However, we believe it will take an entire day or more to open this alternate route.
- NSFD has taped off the bottom of TGC Road. "Road Closed" signs may have also arrived. Anyone attempting to drive down TGC from Bobcat will likely encounter the road grader across the road.
- If you are friends with anyone along TGC Rd, please reach out to them to help alert them to the situation and the possible danger of another mudslide. Some people along the road are not in our HOA.
- We will take it a day at a time. This year’s unprecedented spring-melt is just getting underway. Please do your best to stay safe and thank you everyone for coming together to help each other!
Sunday, April 30, 2023 - Part 1 - Community Protects Tollgate Canyon Road with Sandbags
- Early this morning, neighbors were on Tollgate Canyon Road with shovels and about 200 sandbags in response to a late evening call for help to protect Tollgate Canyon Road from the increasing runoff that is beginning to take a toll on our primary artery with melt-water washing rocks and debris across the road and pushing up through old cracks in the road. In some places water appears to be pushing straight-up through the pavement.
- Jody was on the mini-excavator / backhoe clearing the main ditch on the east side of TGC Road.
- By 10:00 we were up to 250 sandbags placed along the worst sections of the road. We had depleted our stock of empty bags, but we found more.
- North Summit Fire District (NSFD) and Summit County heard what we were doing, unlocked their warehouse, delivered more bags, sent help, shoveled sand, and delivered another truckload of sand because we went through everything.
- Throughout the day, Tollgate residents kept arriving to help - adults and children. What an amazing community we live in!
- How many sandbags did the Community make and place along TGC Road? Somewhere around 500. They are blended with the stone and dirt along our two worst spots.
- NSFD and the Community also delivered sandbags to a home that was beginning to see some water issues.
- The work from today is holding up very well, but new weak spots will crop up.
- If anyone needs help with flooding, please call 911 dispatch and ask for help from NSFD's mobile sandbag crew out of Wanship and Coalville.

Winter Construction Rules Extended until May 15, 2023
Tollgate has continued to receive intermittent snowfall. Our roads remain wet and saturated above the Forest Meadow/Bullmoose intersection and above the Tollgate Canyon Road/Hillcrest intersection. Traditionally, by May 1st, our roads would be dry and clear of ice and snow. This year is very different. If heavy construction equipment is allowed on our roads immediately after May 1st, we will most likely see significant damage that could otherwise be avoided. In light of this, the HOA Board has approved a two-week extension of Winter Construction Rules until May 15, 2023, and will re-evaluate road conditions on May 8th to see if another extension is warranted or not. We understand the inconvenience this creates for some. This year's record snowfall has simply created unprecedented, wet road conditions.

SNOW REMOVAL IN PMRHOA
A. Statement of Purpose
The Pine Meadows Ranch Owners Association (PMRHOA) is seeking a single contract for removal of snow along Forest Meadow road between Junction Court and Arapaho Rd as well as for removal of snow along Arapaho Rd between Forest Meadow Rd and the Pine Meadows Ranch Winter Parking Lot (see EXHIBIT I) for the 2022-2023 winter season not to extend beyond May 31, 2023. All interested must submit a detailed proposal for services no later than October 7, 2022 at 5:00 pm (see instructions below on how to submit proposal).
B. Background Information
PMRHOA serves as the oversight body for Pine Meadow Ranch, roughly 800 privately owned lots, ranging in size from 1/2 to 10 acres. Snow removal for the main entrance/egress road within the neighborhood is managed by this HOA. A secondary entrance/egress route (approximately two and a half miles) requires snow removal and will be contracted out for the 2022-2023 winter season.
C. Tasks to be Accomplished
PMRHOA is seeking to contract for the removal of snow from November 1, 2022 through May 31, 2023, along Forest Meadow road between Junction Court and Arapaho Rd as well as for removal of snow along Arapaho Rd between Forest Meadow Rd and the Pine Meadows Ranch Winter Parking Lot (see EXHIBIT I).
Task 1. Prepare roads for safe snow removal
Timeline: November 1, 2022 through May 31, 2023
Outcome: Conspicuously mark fire hydrants, culverts, power boxes and other roadside obstacles with high visibility markers to prevent damage to snow removal equipment. Hydrant markers should be identifiable as such, and markers must be removed in the spring after the thaw. An example of acceptable markers include 8-10’ tall PVC piping (painted to designate fire hydrants where applicable).
Task 2. Plow snow off sides of roads when snow accumulation is greater than six (6) inches.
Timeline: November 1, 2022 through May 31, 2023
Outcome: Maintain roads free from snow accumulation with a sufficient amount of snow left on the roadway for snow machines to travel, if practical.
Outcome: Remove snow from roadways to an existing drainage ditch in order to provide for drainage in the spring runoff.
Outcome: Begin clearing roadways by 5:00am on snow days and use commercially reasonable best efforts to accommodate early and/or late road use during and immediately after snow storms.
Task 3. Widen roads with a plow and snowblower when snow banks accumulate.
Timeline: November 1, 2022 through May 31, 2023
Outcome: Maintain width of roads not less than the width of two (2) standard vehicles and when limited by the width of the road, at least the width of a standard vehicle.
Task 4. Maintain roads for adequate drainage
Timeline: November 1, 2022 through May 31, 2023
Outcome: Remove snow and slush from the roads into drainage ditches on the side of roadways to facilitate runoff away from road surfaces. When specified by the PMRHOA or the Area, roads will be cleared down to gravel to allow them to dry.

2. A summary of your recent and relevant experience.
3. A firm estimate of the fees to be charged.
4. Would you be willing to submit a normal snow year bid and a low snow year bid?
5. Resumes of all individuals who would be involved in the removal of snow. 5. Include proof of workers compensation coverage.
6. Include a general liability certificate and include proof of payment for 1 year from their insurance company/agent.
7. Names, phone numbers, and email addresses of at least three individuals who have been your clients during the last eighteen months and whom we can contact as references.

Task 2. Plow snow off sides of roads when snow accumulation is greater than six (6) inches.
Timeline: November 1, 2022 through May 31, 2023
Outcome: Maintain roads free from snow accumulation with a sufficient amount of snow left on the roadway for snow machines to travel, if practical.
Outcome: Remove snow from roadways to an existing drainage ditch in order to provide for drainage in the spring runoff.
Outcome: Begin clearing roadways by 5:00am on snow days and use commercially reasonable best efforts to accommodate early and/or late road use during and immediately after snow storms.
Task 3. Widen roads with a plow and snowblower when snow banks accumulate.
Timeline: November 1, 2022 through May 31, 2023
Outcome: Maintain width of roads not less than the width of two (2) standard vehicles and when limited by the width of the road, at least the width of a standard vehicle.
Task 4. Maintain roads for adequate drainage
Timeline: November 1, 2022 through May 31, 2023
Outcome: Remove snow and slush from the roads into drainage ditches on the side of roadways to facilitate runoff away from road surfaces. When specified by the PMRHOA or the Area, roads will be cleared down to gravel to allow them to dry.
Summary of Deliverables and Time Frame
- November 1, 2022 through May 31, 2023
- Mark roads for safe snow removal
- Maintain snow removal according to above guidance
- Maintain width of roads according to above guidance
D. Contract Details
• The contract will begin on November 1, 2022 and terminate on May 31, 2023.
• Subcontractor Insurance Requirements (based on PMR General Liability Insurance Policy):
- The PMRHOA requires the contractor to maintain Commercial General Liability insurance with minimum limits of $2,000,000 per occurrence/$3,000,000 aggregate.
- The subcontractor will need proof of workers compensation coverage.
- The subcontractor will need to provide a general liability certificate.
- The subcontractor will need to provide proof of payment for 1 year from their insurance company/agent.
E. How to Submit a Proposal
Please electronically submit a detailed proposal to PMRHOA no later than October 7, 2022 at 5:00 pm to the Pine Meadow Ranch Owners Association by sending an email to [email protected] and [email protected].
Please be sure to include the following:
1. Equipment you plan to use for snow removal and road widening.
2. A summary of your recent and relevant experience.
3. A firm estimate of the fees to be charged.
4. Would you be willing to submit a normal snow year bid and a low snow year bid?
5. Resumes of all individuals who would be involved in the removal of snow. 5. Include proof of workers compensation coverage.
6. Include a general liability certificate and include proof of payment for 1 year from their insurance company/agent.
7. Names, phone numbers, and email addresses of at least three individuals who have been your clients during the last eighteen months and whom we can contact as references.
A representative of PMRHOA will contact eligible candidates by October 15, 2022.

Bring your trailers, chain saws, hands, and good spirits!
We will meet at The Winter Lot at 8:30am for doughnuts and coffee to have a quick meeting.
Lunch and drinks will be provided. You will also have a chance to win one of our many raffle prizes that includes; a facial and pedicure at Blue Sky, a gift certificate from Tollgate Cleaning Collective, Kodiak Cake goods, Handmade Pasta Cooking Class, and much more.
Our goal is to pick up brush piles left alongside the roadways. If you would like to be apart of the brush pile program, please reach out to your representative to get on the list. Please make sure your pile is no larger than 6’x4’x4’ and able to be picked up by two people.
It is a great way to meet your neighbors and help clean up the mountain.
A clean mountain, is a safe mountain.

But there is simply too much brush on the road and the Alpine crew was looking at 10:00 PM or later to finish. Again, I apologize for the inconvenience. That said, Alpine’s crew is a pretty amazing team. They are doing significantly more work than we are capable of doing.

The crew will be doing the roadside fuel reduction/fire mitigation work that the PMRHOA Board hired them to do.
The detour is to take Forest Meadow Road to Oil Well Road and then reconnect with Tollgate Canyon Road at the end of Oil Well.

AMENDMENT to recently approved Size Guideline 4.4
Dear Owners:
The HOA Board is proposing an Amendment to Architectural Guideline 4.4 - Size. This Amendment follows the Board's July 19, 2022 passage of construction size limits that are based on lot size.
Here is the proposed Amendment:
“All existing lot owners, as of July 19, 2022, are exempt from the maximum allowable square footage restrictions for a period of seven years. The exemption shall terminate upon the earlier of seven years or a transfer of title for value, whichever comes first.”
Why propose this Amendment?
Your Board's goal is to make decisions that represent the interests of the community as broadly as possible. During the previous public comment period from June 17, 2022 through July 18, 2022, we received 157 responses from the community. Of these responses, 57.3% were in favor of the rule change, 39.5% were opposed to it or would have changed the wording of the proposal, and 3.2% were indifferent to the proposed rule. This proposed Amendment is intended to acknowledge and respect the positions of the 39.5% who are opposed to the enacted construction size limits. It represents a middle ground that we hope bridges these differences of opinion.
What follows is a single-page for you to indicate whether or not you are in favor of the proposed Amendment. You may also use this form to provide written comments to the Board.
This form will stop accepting comments at 12:00 Noon on Tuesday, August 16, 2022. You will have another opportunity to comment at the August 16, 2022, Board meeting. The Board's vote on the proposed rule change is tentatively scheduled for August 16, 2022.

The Pine Meadow Ranch Fire Safety Committee has drafted and proposed a Fire Mitigation Rule for new construction. You may download a PDF copy of the proposed rule here.
At the February Board meeting, the Board voted to present the proposed rule to the community for comment.

Many hands makes light work. A huge THANKS to all our neighbors on and off the ranch that came out and brought equipment and their time to help clean up the lower canyon to help mitigate fire danger.
Tollgate Canyon Fire Mitigation Clean up
Our Fire Safety committee has organized a clean up of lower Tollgate Canyon to mitigate fire danger. Please join us as you are able on Saturday July 10th 2021 from 9 - 3 (possibly Sunday as well depending on progress).
Reminder the ROAD WILL BE CLOSED in both directions from the dumpster turn off to Oilwell in both directions for the safety of the volunteers.
